Unconstitutional

The Supreme Court, the highest court in the United States, could rule that legislation was unconstitutional—contrary to the Constitution’s rules about government powers. Its objections were therefore different from simply saying that a policy was expensive or ineffective.

The Supreme Court could rule that laws were unconstitutional. Its opposition therefore had a different effect from speeches or campaigns: it could stop New Deal measures operating.
